Much of Farmington's historic core has no HOA, while many west-side subdivisions and townhome projects do. When there is one, the documents deserve the same attention as the inspection.
Documents to request
Ask for these as early as possible in due diligence.
CC&Rs, bylaws and rules
Current budget and reserve study, if there is one
Recent meeting minutes
Current dues and any pending or recent special assessments
Questions that save headaches
Exactly what do the dues cover?
Are rentals allowed, capped or restricted?
What are the parking, pet and exterior-change rules?
Is any litigation or major repair under discussion?
Mind the deadline
Utah purchase contracts give you a due-diligence window. If the HOA picture doesn't work for you, that is the time to raise it — not after the deadline passes.
Get the HOA documents early, read the rules against your plans, and decide before your due-diligence deadline.
